Terms & Conditions
The conditions set out here constitute my terms of sale. Please contact me for clarity on any matter which is not clear or you do not understand and note that nothing contained here affects your statutory rights as a consumer.
Check your order
-
While I take every measure to check each order it is also the responsibility of the client to ensure the details are correct.
Pricing, deposits and payments
-
The price is set out on the order form. This includes design, creation, baking, decorating and administration to complete your order. Any order created more than a year in advance will be a guide price only and will be re-priced six months before the required date. This is due to the ever-increasing food prices.
-
Your order is only confirmed on receipt of a non-refundable booking fee. For wedding cakes this is £100.00, for occasion cakes it is £50.00. By paying this, you are agreeing to the terms and conditions as set out here.
-
For wedding cakes, the balance is due one month before the wedding. For occasion cakes, it’s two weeks before the due date. A reminder email will be sent the week before. Non-payment will result in the cake being cancelled and the loss of any fees paid to date.
Cancellation/Postponement
-
This agreement can be cancelled by either party in writing/email subject to this clause.
-
If I cancel the agreement any fees paid minus the non-refundable booking fee will be refunded within seven days.
-
If you cancel the agreement prior to one month before your event, any fees paid minus the non-refundable booking fee will be refunded within seven days.
-
If you cancel the agreement within 1 month of the event for wedding cakes and within 14 days of the event for occasion cakes, the full value of the order is to be paid. This is due to the time spent, work completed on your order and loss of business due to your booking preventing further bookings for that date.
-
If you need to postpone your order, any monies paid will be carried over to the new date.
Design changes/alterations
-
You acknowledge that I own all right, title and interest in the design created for this order and that you have no rights to use it outside of this agreement.
-
Minor changes to the design are acceptable, however a substantial change may then require a re-price of the order.
-
I reserve the right to make minor changes to the order to compensate for factors that may affect the quality of the cake, e.g. weather conditions. You will be notified of these changes and they will be as minimal as possible.
Ingredients & allergens
-
A full ingredient listing will be provided along with any allergen advice. This will be left with the cake. If you have ordered a wedding cake this information will be given to the venue.
-
Whilst I will do everything to cater for allergen sufferers, you accept that I cannot be held responsible for any allergies of reactions caused by my cakes. I can make cakes without allergens but they are made in a kitchen that uses ingredients containing allergens.
-
I also cannot guarantee that my cakes do not contain allergens due to the manufacture processes of the ingredients and any residual traces of known allergens.
-
Where I have been asked for allergen free cakes, you acknowledge that I will strive to eliminate contact with the allergens but as I do not specialise in allergen free cakes, a 100% allergen free cake cannot be guaranteed. By paying the booking fee, you agree to this clause and accept the risk.
-
It is your responsibility to advise your guests of these risks.
-
It is your responsibility to advise me of any allergens that will affect how I make the cake.
-
Any allergen free cake will be clearly identified and the venue advised.
-
Non-edible decorations
-
My cakes may contain non-edible items , e.g. dowels, sugar flower, posy picks, ribbon, etc. These will be detailed on the handover sheet and I will go through these in detail either with you for occasion cakes or with the venue for wedding cakes. It is your responsibility to ensure these are removed before serving.
-
I take no responsibility for this once the cake has been delivered and signed off.
-
For sugar flowers or models that you wish to keep, you or the venue will be instructed on how to remove these from the cake. For sugar flowers, a box will be provided for you to take them home.
Delivery
-
I deliver all my cakes and set them up at the venue to ensure they reach you in perfect condition. I will liaise with your venue coordinator to arrange this. For occasion cakes, I will deliver to the agreed address and explain everything to you.
-
I accept no liability for damage to cakes once they have been delivered and signed off. I take a photo prior to leaving as proof of their condition.
-
It is your responsibility to ensure the venue supplies a suitable table & location for the cake. Should I have an issue with the set-up, I reserve the right t set the cake up in a more suitable location, e.g. out of sunlight.
-
I do everything I can to deliver within the agreed timescale. However, sometimes issues outside of my control may delay delivery, e.g. traffic delays, road closures. I will not be held responsible for these delays.
-
The cost of delivery is set out on the order form. This is charged at he HMRC rate of 55p per mile return.
Other
-
Your cake is baked fresh to order, not frozen.
-
As your cake takes a few days to complete, the best before dates are usually within three days of the event. You/the venue will be advised of this and any storage requirements at the time of handover. I will not be held responsible for the quality of the cakes consumed after this time.
-
I will not be liable for any breach of contract due to force majeure.
-
I will not provide a wedding cake where another supplier (including relatives of the client) has provided any other cake related products unless previously agreed. I reserve the right to remove the cake and retain payment if any other cakes as detailed above are served at your wedding.
-
I reserve the right to use images of your cake/design for any promotional purposes.
Customer satisfaction/complaints
-
Complaints are rare and taken seriously. In the unlikely event that you are unhappy with the cake, I will do everything I can to rectify the matter. You must notify me within 48 hours of any issues and include evidence.
-
If it is a design issue, these must be expressed at the time of delivery. If it’s a wedding cake, a photo of the cake is to be emailed within 48 hours of the cake being delivered, explaining the discrepancy.
-
If it is a quality issue, 75% of the cake must be returned to me within 24 hours to ensure a fair assessment of the issue and conclude the course of action to be taken. . If the cake is not returned, a refund will not be given.
-
You will not post ay negative comments or feedback on any online forum, website or social media without providing written advanced notice of the content and giving me the opportunity to resolve the issue.
